Kerala High Court Grants Bail to Greeshma in the Sharon Murder Case

In a case that shook many people in October 2022, 23-year-old Sharon Raj tragically lost his life due to organ failure after allegedly being poisoned by his girlfriend, Greeshma. The Kerala High Court has recently made a significant decision by granting bail to Greeshma, who is considered the prime accused in the murder of Sharon Raj. Greeshma, previously identified as the girlfriend of Sharon Raj, has been accused of orchestrating his murder by administering a poisoned drink. The case took a significant turn when Justice Mohammad Nias CP passed an order granting bail to Greeshma, citing the completion of the final report and her cooperation with the investigation as key factors in this decision.

Justice CP emphasized that bail should not be denied based on public sentiments against the accused. The order underscored that the right to bail should not be withheld as a form of punishment while awaiting trial, regardless of the seriousness of the accusations. The tragic sequence of events leading to Sharon Raj’s untimely death began with a seemingly ordinary college romance. Sharon and Greeshma met as students at a private college in Kanyakumari, where Sharon pursued radiology studies, and Greeshma focused on literature. Their relationship, which allegedly spanned approximately a year, took a dark turn when Greeshma decided to end it due to her family’s plans for her to marry another man. Sharon’s unwillingness to accept the breakup allegedly led Greeshma, along with her mother and uncle, to conspire to poison him, according to the prosecution’s claims.

The prosecution alleges that during a visit to Greeshma’s house in Kanyakumari, Tamil Nadu, Greeshma served Sharon a drink laced with a poison she had prepared. Her mother and uncle are said to have concealed the bottle containing the deadly substance. Tragically, Sharon Raj’s health deteriorated rapidly in the following days, ultimately resulting in his death on October 25, 2022, due to multiple organ failure. Within a week, Greeshma found herself under arrest, with her mother and uncle subsequently apprehended in connection with the case.

While Greeshma’s mother and uncle were able to secure bail, Greeshma remained incarcerated, prompting her to approach the High Court seeking bail. Her legal team argued that her continued detention was unnecessary since the investigation had been completed, the final report had been filed, and she had cooperated fully with the investigation. Additionally, it was pointed out that Sharon’s dying declaration had not implicated Greeshma.

Considering the circumstances and the fact that Greeshma was only 22 years old, having spent time behind bars since October 31, 2022, the High Court decided to grant her bail, subject to certain conditions. Greeshma was represented by advocate Sasthamangalam S Ajithkumar in this matter.

In a related development, Justice PV Kunhikrishnan is currently reviewing a joint plea submitted by Greeshma, her mother, and her uncle. This plea challenges the Kerala trial court’s decision to not transfer the case to Tamil Nadu, which is argued to be the appropriate jurisdiction for the case since the alleged crime occurred in Tamil Nadu.

Justice Kunhikrishnan has admitted the plea and issued a stay on the Kerala trial court’s order for a period of three weeks. This decision underscores the complexity of the legal proceedings surrounding this tragic case, as well as the significance of jurisdictional issues in the administration of justice.
