Delhi Court Awards Death Penalty to Three Men in Brutal Gangrape-Murder of Woman and Her Children

In a harrowing and heart-wrenching case that shook the conscience of the nation, a recent verdict from a Delhi Court has sent shockwaves through society. The court has awarded the death penalty to three men involved in the brutal gang-rape and murder of a woman, along with her two minor children, a 7-year-old boy and a 6-year-old girl. The gruesome incident unfolded in the vicinity of the Khyala police station, and it has left scars that will never heal for the victims’ family.

The gruesome events transpired in 2015 when an FIR was registered based on a complaint filed by the deceased woman’s husband. Four individuals, including one minor, were implicated in the horrifying rape and murders that shook the nation to its core.

The Special Fast Track Court Judge Aanchal of Tis Hazari Court has pronounced the death sentence for Shahid, Akram, and Rafat Ali, also known as Manzoor Ali, for their involvement in the heinous crimes under Section 302 (murder) and 120B (criminal conspiracy). Additionally, they have been sentenced to life imprisonment for their roles in the gang-rape and robbery. The court has imposed a fine of ₹35,000 on each of the convicts.

The court’s judgment was delivered on August 22, following an exhaustive trial that meticulously examined the evidence surrounding this gruesome case. The court’s reasoning for the death penalty was grounded in a substantial chain of evidence, revealing the accused’s movements before and after the commission of the crimes.

The court highlighted that the three accused, Shahid, Rafat Ali, and Akram, conspired in the planning and execution of these horrific acts. The prosecution’s case was bolstered by call records and related evidence, including recoveries made in response to disclosure statements. These records presented a compelling narrative of the accused’s involvement in the crime.

The court noted a pattern in the communication between the accused, with calls being made not in rapid succession but strategically, with a deliberate time lapse. This pattern was particularly telling around the time of the murders, indicating a level of coordination that implicated all four accused, including the juvenile. The court emphasized that the accused were sharing a common agreement to commit these reprehensible offenses.

The FIR for this case was registered on the statement of the deceased woman’s husband, who returned home to discover the horrifying scene. He had left his wife and children at home while he was away for work. Upon his return, he found the door latched from the outside. As he entered, he made the grisly discovery of his wife and two children, lifeless and with signs of violence inflicted upon them. His wife had been strangled with a dupatta, while his daughter had been similarly murdered with a handkerchief.

Adding to the brutality of the crime, the accused had also robbed the house, taking valuable jewelry and a sum of ₹18,550. Suspicion fell on one of the tenants, Shabbu, who reported that he had seen Akram and a minor, identified as ‘H,’ along with two other boys entering the deceased’s room that night and locking the door.

The complainant’s doubts about the involvement of Akram, ‘H,’ and their associates led to further investigation. Upon receiving information, two of the accused, Shahid and Mohd. Akram, were apprehended on October 4, 2015, near HMP Raghuvir Nagar. They subsequently confessed to the murder, robbery, and gang-rape, implicating Manzoor and ‘H.’ The case was then converted to include charges under Section 376(D) IPC (gang rape).

In the course of the arrests, police found incriminating evidence, such as mobile phones with multiple IMEI numbers and SIM cards in the possession of the accused. These findings further linked the perpetrators to the crime.
